Claiming compensation for sex without consent
Abuse lawyer, Carly Sylvester was recently contacted by Ms R who was looking for legal advice in relation to an incident of domestic sexual assault with a view to claiming compensation for sex without consent.
Ms R had been in a long-term relationship with her partner when she began to experience pressure from her partner to engage in sexual activities. He became insistent that they participated in anal penetration, despite Ms R’s repeated rejections.
On one occasion, while the couple were engaging in consensual vaginal intercourse, her partner stopped and started to anally penetrate her, which she did not consent to.
Ms R made a report to the police, but ultimately the investigation was closed due to a lack of evidence.
Ms R then contacted Carly Sylvester in relation to making a civil claim. Carly advised her that she could seek compensation from the Criminal Injuries Compensation Authority (CICA) as she had been a victim of a violent sexual crime and had co-operated with the police so far as possible.
Ms R therefore asked Carly to proceed with making a claim on her behalf which Carly did on a No Win – No Fee basis.
An application for criminal injuries compensation was submitted to the CICA and after medical and police records were obtained, Ms R was made an offer of £16,500 in compensation for non consensual sex.
